Terms of service

Overview

Welcome to The Son of a Butcher Direct (“TSOB Direct,” “we,” “us,” or “our”). We operate this store and website, including the information, content, features, tools, products, and services offered through it (collectively, the “Services”). The Services are powered by Shopify.

These Terms of Service (“Terms”) describe your rights and responsibilities when you access or use the Services, create an account, place an order, or otherwise interact with us.

By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you should not use the Services.

1. Access and Accounts

By using the Services, you represent that you are at least the age of majority in your state or jurisdiction of residence or are otherwise legally permitted to use the Services.

You agree to provide accurate, current, and complete information when creating an account, placing an order, or otherwise using the Services.

You are responsible for maintaining the confidentiality and security of your account credentials and for activity occurring through your account. You may not sell, transfer, assign, or license your customer account to another person.

We may suspend or restrict access to an account when we reasonably believe it is being used fraudulently, unlawfully, or in violation of these Terms.

2. Products and Product Information

We make reasonable efforts to present our products accurately, including product descriptions, photographs, weights, grades, origins, package sizes, preparation information, and other product details.

Because many of our products are natural food products, reasonable variation may occur in color, marbling, shape, trim, size, weight, appearance, or other characteristics. Product photography is representative and may not depict the exact item you receive.

Displayed colors may also vary depending on your screen, device, and display settings.

Product descriptions, specifications, availability, pricing, and other product information may be updated at any time without notice. We may discontinue products, limit quantities, or restrict availability by location or other reasonable criteria.

Where a product is sold by an approximate weight or range, the actual item may vary within the stated range.

3. Orders and Order Acceptance

Submitting an order is an offer to purchase the products in that order.

We reserve the right to accept, decline, limit, or cancel an order when reasonably necessary, including because of product availability, pricing or description errors, payment issues, suspected fraud, shipping restrictions, or other operational concerns.

An order is not final until payment has been successfully processed and we have accepted the order.

Please review your order carefully before submitting it. Because many products are perishable and orders may enter fulfillment quickly, we may be unable to accommodate cancellation or modification requests after an order has been accepted.

If we decline, cancel, or materially modify an order, we will attempt to notify you using the contact information provided with the order.

Products purchased through the Services are intended for lawful personal, household, gifting, or other permitted use. Unauthorized resale or export is prohibited.

4. Prices, Promotions, and Billing

Prices, discounts, offers, shipping charges, and promotions may change without notice.

The price charged for a product will be the price shown at the time the order is submitted, subject to correction of obvious errors and any applicable promotional terms.

Unless otherwise stated, product prices do not include applicable taxes, shipping charges, or other charges shown during checkout.

Promotions may have separate eligibility requirements, exclusions, expiration dates, minimum purchase requirements, or other terms. If promotional terms conflict with these Terms, the promotional terms control for that promotion.

You agree to provide current, complete, and accurate billing, payment, and account information.

By submitting payment information, you represent that you are authorized to use the payment method and authorize the applicable charges associated with your order.

5. Perishable Products and Food Safety

Many products sold through TSOB Direct are perishable and require proper handling after delivery.

You are responsible for promptly receiving or retrieving your shipment and for refrigerating, freezing, or otherwise storing products appropriately after delivery.

You should inspect products upon receipt and follow applicable package instructions, storage guidance, safe-handling practices, and cooking recommendations.

Raw or undercooked meat, poultry, seafood, or other foods may present food-safety risks. Customers are responsible for preparing and storing products safely and for considering any individual dietary restrictions, allergies, or medical concerns.

Information provided through the Services is intended for general product and educational purposes and is not medical, nutritional, or professional health advice.

If an order arrives damaged, spoiled, incorrect, or otherwise unsuitable for use, please follow our Refund Policy and contact us promptly.

6. Shipping and Delivery

Shipping availability, methods, rates, carrier services, delivery estimates, and shipping restrictions are described during checkout and in our Shipping Policy.

Delivery dates and transit times are estimates and are not guarantees. Delays can occur because of weather, carrier disruptions, holidays, address issues, service interruptions, events outside our control, or other circumstances.

You are responsible for providing a complete and accurate shipping address and for ensuring that the delivery location can receive the shipment.

Because orders may contain perishable products, you are responsible for promptly retrieving delivered packages and following appropriate storage instructions.

Where available, package-protection or delivery-related services offered through third-party providers may be subject to additional terms from those providers.

Our obligations regarding lost, delayed, damaged, spoiled, or incorrectly delivered orders are subject to our Refund Policy, Shipping Policy, applicable carrier procedures, and applicable law.

7. Refunds, Replacements, and Order Issues

Purchases are subject to our Refund Policy.

Because we sell perishable food products, physical returns may not be accepted. Eligibility for refunds, replacements, credits, or other resolutions depends on the circumstances described in the Refund Policy.

If there is a problem with your order, contact us as soon as reasonably possible and provide the information requested in the Refund Policy, which may include your order number and photographs of the product, packaging, or shipping condition.

8. Intellectual Property

The Services and their content, including trademarks, logos, brand names, text, images, photography, graphics, videos, audio, product content, design elements, software, and the selection and arrangement of those materials, are owned by or licensed to TSOB Direct or its affiliates and are protected by applicable intellectual-property laws.

You may use the Services for lawful personal and non-commercial purposes.

Except as expressly permitted by us or applicable law, you may not reproduce, distribute, modify, republish, publicly display, publicly perform, sell, license, or create derivative works from protected content on the Services.

The names, logos, product names, designs, and slogans associated with TSOB Direct, The Son of a Butcher, and their affiliates may be trademarks or other protected intellectual property and may not be used without permission.

9. Optional Tools and Third-Party Services

The Services may provide access to features, applications, integrations, payment methods, shipping services, package-protection services, analytics tools, or other services provided by third parties.

Third-party services may be governed by their own terms and privacy policies.

We do not control third-party services and are not responsible for their independent acts, omissions, availability, security, or content, except as required by applicable law.

Your use of third-party services is at your own discretion and may be subject to separate agreements between you and the applicable provider.

10. Third-Party Links

The Services may contain links to websites, applications, content, or services operated by third parties.

We are not responsible for the content, accuracy, availability, security, privacy practices, products, or services of third-party websites or platforms.

You should review the applicable policies and terms before interacting with third-party websites or services.

11. Relationship with Shopify

TSOB Direct is powered by Shopify, which enables us to provide the Services to you.

However, purchases and sales made through our store are transactions directly between you and TSOB Direct. Shopify is not the seller of the products offered through our store.

To the fullest extent permitted by applicable law, Shopify is not responsible for injury, damage, loss, or other claims arising from products purchased directly from TSOB Direct.

12. Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because the Services are hosted by Shopify, Shopify also collects and processes certain personal information relating to access to and use of the Services. Additional information about Shopify’s processing is available through Shopify’s applicable privacy policies.

By using the Services, you acknowledge that information may be transmitted to Shopify and other service providers as described in our Privacy Policy.

13. Reviews, Feedback, and User Submissions

If you voluntarily submit reviews, feedback, suggestions, photographs, ideas, comments, or other content (“Feedback”), you represent that you have the right to submit that content and that it does not violate applicable law or the rights of another person.

To the extent permitted by law, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, publish, display, distribute, and otherwise use Feedback for operating, improving, and promoting the Services.

We are not required to maintain Feedback in confidence, pay compensation for Feedback, or respond to Feedback unless otherwise agreed in writing.

We may remove or decline to publish Feedback that we reasonably believe is unlawful, fraudulent, abusive, infringing, misleading, obscene, or otherwise inappropriate.

14. Errors, Inaccuracies, and Omissions

The Services may occasionally contain errors, inaccuracies, or omissions relating to product descriptions, availability, prices, promotions, shipping charges, transit times, product information, or other content.

We reserve the right to correct errors, update information, change or cancel promotions, and cancel or adjust orders affected by material inaccuracies, subject to applicable law.

15. Prohibited Uses

You may use the Services only for lawful purposes.

You may not use the Services to:

  • violate applicable laws or regulations;

  • infringe intellectual-property, privacy, publicity, or other rights;

  • engage in fraud, impersonation, deception, harassment, abuse, threats, or unlawful conduct;

  • upload, distribute, or introduce malicious code;

  • interfere with the operation, availability, integrity, or security of the Services;

  • attempt to gain unauthorized access to systems, accounts, data, or restricted portions of the Services;

  • collect personal information about others without authorization;

  • send spam, phishing messages, or other unauthorized solicitations;

  • bypass technical controls, CAPTCHAs, access restrictions, or security measures; or

  • use the Services in a manner that materially harms TSOB Direct, our customers, our service providers, or the operation of the Services.

16. Automated Access and Agents

Automated access to the Services is permitted only when it is lawful and consistent with the permissions we make available through mechanisms such as robots.txt, other machine-readable instructions, published APIs, or express authorization.

Public search-engine crawlers and other automated systems may access publicly available portions of the Services when they comply with applicable technical permissions and do not circumvent security, rate limits, authentication requirements, or other access controls.

Automated systems, agents, bots, scrapers, or similar technologies may not:

  • conceal or misrepresent their identity when identification is reasonably required;

  • circumvent CAPTCHAs, authentication, rate limits, robots.txt restrictions, or other technical controls;

  • access non-public account or customer information without authorization;

  • interfere with the normal operation of the Services; or

  • use the Services for unlawful, fraudulent, abusive, or security-threatening purposes.

We may limit or block automated access that violates these Terms or our technical access controls.

17. Termination and Suspension

We may suspend or terminate access to the Services or an account when reasonably necessary because of fraud, abuse, security concerns, unlawful activity, violation of these Terms, or other legitimate business or legal reasons.

You remain responsible for amounts properly owed for transactions completed before termination.

Provisions that by their nature should survive termination will remain in effect, including provisions relating to intellectual property, Feedback, disclaimers, limitations of liability, indemnification, privacy, governing law, and other accrued rights or obligations.

18. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

We do not guarantee that the Services will always be available, uninterrupted, secure, error-free, or free of harmful components.

Except as expressly stated by us or required by law, we disclaim warranties and conditions of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, durability, and non-infringement.

Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.

19. Limitation of Liability

To the fullest extent permitted by applicable law, TSOB Direct and its affiliates, owners, directors, officers, employees, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, punitive, special, exemplary, or consequential damages arising from or relating to the Services, these Terms, or products purchased through the Services.

This includes, where permitted by law, loss of profits, revenue, savings, data, goodwill, or business opportunities.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless TSOB Direct and its affiliates, owners, directors, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, damages, liabilities, and reasonable legal costs arising from your material violation of these Terms, applicable law, or the rights of another person.

21. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will remain in effect.

22. Waiver and Entire Agreement

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms, together with policies and other terms incorporated by reference, constitute the agreement governing your use of the Services and supersede prior agreements relating to the same subject matter.

23. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer our rights or obligations under these Terms in connection with a business transaction, reorganization, affiliate relationship, or other lawful business purpose.

24. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles, except to the extent applicable law requires otherwise.

Subject to any rights you may have under applicable consumer-protection law, disputes relating to these Terms or the Services may be brought in the state or federal courts located in or serving Jefferson County, Alabama.

25. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Services, business practices, policies, technology, or legal requirements.

When we make changes, we will post the updated Terms and revise the “Last updated” date.

Where required by applicable law, we will provide additional notice of material changes.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
